Killing of Legal Practitioner Sparks Alarm Over Threats to South Africa’s Justice System

Johannesburg, Gauteng – The fatal shooting of a legal practitioner in the Johannesburg CBD has raised serious concerns about the safety of professionals working within South Africa’s criminal justice system.

The Business Against Crime South Africa has condemned the incident, warning that the targeting of legal professionals represents a direct threat to the rule of law and the country’s democratic stability.

Growing Threats Against Justice System Professionals

According to BACSA, the killing is part of a broader and worrying trend where:

  • Legal practitioners
  • Prosecutors
  • Investigators
  • Witnesses

are increasingly exposed to intimidation, violence, and targeted attacks.

Experts say such violence is often linked to organised crime networks, where intimidation is used to:

  • Influence court outcomes
  • Disrupt investigations
  • Avoid accountability

 International Warning Signs

Global research, including findings from the Global Initiative Against Transnational Organized Crime, indicates that attacks on justice system actors are common in highly criminalised environments.

These findings highlight the urgent need for:

  • Stronger protection mechanisms
  • Improved institutional coordination
  • Increased accountability

“An Attack on the Rule of Law”

BACSA CEO Anton du Plessis stressed the seriousness of the incident:

“This is not just another violent incident. When officers of the court are targeted, it undermines the integrity of the rule of law.”

He warned that if legal professionals cannot operate safely, the entire justice system is weakened.

Calls for Stronger Protection Measures

While South Africa has an established witness protection system, BACSA says current threats require broader safeguards for professionals working within the justice system.

Key concerns include:

  • Expanding protection beyond witnesses
  • Addressing risks faced by legal practitioners and prosecutors
  • Strengthening coordination between law enforcement agencies

Impunity Fuelling Violence

BACSA also highlighted impunity as a major driver of violence, warning that when perpetrators believe they can act without consequences, attacks on justice officials are more likely to increase.

Role of Government and Society

BACSA emphasised that addressing the issue requires strong leadership from the State, including:

  • Prioritising cases involving attacks on justice officials
  • Improving law enforcement coordination
  • Ensuring consistent prosecution outcomes

While business and civil society can assist, the organisation stressed that responsibility ultimately lies with government.

Protecting Democracy and Stability

The organisation concluded that protecting those who uphold the law is essential for maintaining:

  • Public confidence in the justice system
  • South Africa’s democratic institutions
  • Economic stability

As concerns grow, stakeholders are calling for urgent action to safeguard the individuals who play a critical role in upholding justice in the country.
