Sedibeng, Gauteng – A political storm is unfolding at the Sedibeng District Municipality following allegations that the Municipal Manager unlawfully removed the Speaker of Council, raising serious concerns about governance, legality, and service delivery in the region.
The Democratic Alliance has strongly condemned the move, describing it as a direct attack on democratic processes and a violation of the law. According to the party, the removal of Speaker Moipone Modikeng did not follow proper legal procedures as outlined in the Municipal Structures Act.
Legal Concerns Over Speaker Removal
At the centre of the dispute is Section 27 of the Municipal Structures Act, which states that a seat at district level can only be declared vacant if the relevant local council formally recalls the representative.
The DA argues that:
- No such recall process took place
- Council did not approve the removal
- Proper legislative procedures were bypassed
Despite this, the Municipal Manager allegedly issued a vacancy notice to the Independent Electoral Commission without council approval.
DA to File PAIA Application
In response, the DA has confirmed it will submit a formal application under the Promotion of Access to Information Act (PAIA) to obtain full details on:
- The process followed in removing the Speaker
- Supporting documentation
- Legal justification for the decision
The party says it is determined to hold those responsible accountable.
Impact on Budget and Service Delivery
The controversy comes at a critical time, as Sedibeng has yet to pass its adjustment budget. Without a Speaker to preside over council proceedings, delays are expected—potentially worsening already strained service delivery in the district.
Opposition leaders warn that continued instability could:
- Delay key municipal decisions
- Disrupt governance processes
- Further impact basic services for residents
Political Tensions Within the ANC
The situation is unfolding against the backdrop of ongoing internal conflict within the African National Congress in Sedibeng.
Reports indicate:
- Prolonged tensions between the Mayor and Speaker

- A failed effort by provincial leadership to resolve the dispute
Meanwhile, the Pan Africanist Congress has tabled a Motion of No Confidence against the Mayor, with opposition parties believed to have enough support to pass the motion.
The DA claims that internal political battles may be influencing governance decisions, including the controversial removal of the Speaker.
